- June 2008 – Our client, a web site designer was sued by Getty Images for using copyright images without a licence – Insurers settled the claim at £1550 under the Copyright Infringement section of the policy.
- April 2008 – A Design Engineer was commissioned to design an ice cream tub for a new brand of ice cream. Unfortunately the measurements were incorrect and his client sued for damages when a new template had to be made. Insurers settled this claim at £3050”
- Sept 2006 – Incorrect measurements on plans caused a house to be built in the wrong place. The builder sued our client for damages amounting to £61,000 which the insurers paid”
23/08/2006 Employers Liability Claims Example
The claimant slipped on stairs whilst carrying a hoover and suffered injury.
No admission of liability has been made in this case and it remains insurers position that the Claimant's employment with the defendant was purely for his financial advantage and had nothing to do with any element of control. The weakness in this argument is that the Claimant does have an employment contract with the defendant which includes the provision that '...it is the policy of the Company to maintain the health and safety of all its employees'.
To date no settlement negotiations have been entered into, however, our legal advisors are of the view that should the Claimant decide to pursue his action against the defendant and be still willing to settle on the terms initially proposed, it would not be viable from a tactical or economical point of view to continue to refute this claim. Nothing heard from the Claimant's solicitors for almost a year now and the file has been closed.
12/12/2008 (Professional Indemnity Claims Example)
Defendant was appointed as structural engineer on refurbishment of house. Problems have occurred with first floor dropping, thought to be due to weight of underfloor heating not indicated on original drawings and therefore not taken into account by the Defendant. Defendant has repudiated liability and we are at present awaiting comments from insurer. Architect is holding Project Managers at fault, they are the owners so claim will hopefully be closed.
