Professional Contractors Group (PCG) has in the last month published an article on Temporary Agency Workers Directive
The Temporary Agency Workers Directive (TAWD), still looks likely to exclude genuine contractors who work through limited companies. Last month, the Government published detailed draft regulations and is consulting on them until December. The Directive aims to give agency workers equal treatment after 12 weeks in the same post. Originally, it appeared likely that this would include contractors and freelancers - clearly not the intended target of legislation, and a move which be damaging for freelancers and create much uncertainty for end clients. Extensive lobbying by PCG and others, including the Recruitment and Employment Confederation (REC), has ensured most PCG members initially appear out of scope in the Government's draft proposals. This final consultation will be the last chance to have a say on the Directive before it will be implemented. PCG will be studying the draft regulations closely to ensure most PCG members remain clearly out of scope. The Directive is still very likely to apply to umbrella workers.
